When using ConferenceCall.com, services ("Services"), and all hardware and software operated in connection therewith ("System") you agree to the terms and conditions listed on this page (the "Terms of Use").
If you order or use any ConferenceCall.com services or visit our Website, you accept these Terms of Use so please read them carefully. In addition, when you use any current or future ConferenceCall.com services whether or not included in our Website, you will also be subject to our current Terms of Use.
To understand our practices, please review our privacy policy that also governs your visit to our Website and use of our services. A complete statement of our privacy policy is found below.
1. PERSONAL INFORMATION. We will ask you to provide us with information that personally identifies you or allows us to contact you ("Personal Information") when, among other things, you register on the ConferenceCall.com Site, use one of our services, fill out a survey, make a request for information, or enter a sweepstakes or contest through the ConferenceCall.com Site. We will use the Personal Information that you provide us in these circumstances to operate the ConferenceCall.com Site, to provision, deliver, bill and collect for services as well as provide information that you request from the ConferenceCall.com Site.
Unless you instruct us not to do so, ConferenceCall.com may also use the Personal Information that you provide us to contact you regarding additional or new services and features offered by ConferenceCall.com, special offers by ConferenceCall.com, or important information regarding ConferenceCall.com.
2. DISCLOSURE FOR LEGAL PURPOSES. We may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary: (a) to conform to the edicts of the law or comply with legal process served on us or our affiliates, (b) to protect and defend our rights or property or those of our users, (c) to act immediately to protect the personal safety of our users or the public, or (d) in connection with a merger, consolidation or sale of substantial assets of ConferenceCall.com. As we continue to develop our business, we might buy or sell assets related to our business. In such transactions Personal Information generally is one of the transferred business assets. Also, in the event that ConferenceCall.com or substantially all of its assets are acquired, Personal Information will be one of the transferred assets.
3. ANONYMOUS INFORMATION. Please understand that, in addition to collecting Personal Information, ConferenceCall.com will also gather information that does not personally identify you regarding your use of the ConferenceCall.com Site ("Anonymous Information"). The Anonymous Information that we collect regarding your use of the ConferenceCall.com Site may be used by us to measure the effectiveness of marketing efforts on the ConferenceCall.com Site: for improving the services we offer to you.
By submitting the Account Application, you (1) certify that all information provided is true and complete, (2) authorize ConferenceCall.com to verify all of your statements with any source to obtain a credit report concerning this information, (3) authorize ConferenceCall.com to charge you or your firm for services rendered, (4) agree to pay for services rendered to your satisfaction, (5) will notify ConferenceCall.com of any disputes or concerns within 30 days of invoice date, (6) agree that ConferenceCall.com's liability in any dispute shall be limited to reimbursement of amounts paid by you for services, and (7) acknowledge that you have ready and understood the information contained in this document. Rates and Services are subject to change without notice.
Billing Procedures
1. Invoices are processed every 15 days.
2. Ready-Call® accounts will be billed for actual per-minute usage.
3. Event Services:
- Two-hour cancellation/change notice required to avoice $6 administrative fee.
- Fifteen-minute minimum billing time for Event Services.
- Listen-Only and Operator Assisted billing calculated from start to end time for lines used.
- Meet-Me billing based on average usage of all lines (minimum applies).
4. All disputes must be submitted within 30 days of invoice date.
5. All services guaranteed to your satisfaction.
All rights that are not granted to you are reserved by ConferenceCall.com. The Services, System, our technology, and any updates or improvements to the Services, System, or our technology, are owned by ConferenceCall.com and its licensors. ConferenceCall.com and our licensors own all copyrights, patents, trademarks, trade secrets, and other intellectual property rights relating to or residing in our Services, System and technology. You will have no right, title, or interest in or to the same. Nothing in this Agreement will be deemed to grant, by implication, estoppel, or otherwise, a license under any of ConferenceCall.com's or its licensor's, existing or future rights in or to the Services, System or our technology and any updates or improvements thereto. You understand that our Services, System and technology contain valuable software and confidential information and you agree that you will not modify, reverse engineer, decompile, create other works from, or disassemble any of our software without our prior written consent.
ConferenceCall.com, ConferenceCall.com Communications, and our graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of ConferenceCall.com Communications, Inc. ConferenceCall.com trademarks and trade dress may not be used in connection with any product or service that is not provided or authorized in writing by ConferenceCall.com, or in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ConferenceCall.com. All other trademarks not owned by ConferenceCall.com that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by ConferenceCall.com.
We will send you a monthly invoice for your use of the services. You agree to pay the invoice by the due date. If you do not pay the entire invoice by the due date we may apply a late payment charge at the lesser of one and one half percent (1.5%) per month or the highest rate permissible under the applicable law. At any time, we may require a deposit or other form of advance payment prior to providing or continuing to provide Service based on our evaluation of your credit, or we may terminate Services immediately if you fail to make payments by the due date. Unless we otherwise agree in writing, we may adjust our fees at any time.
You are responsible for the content of the messages you communicate when using our services as well as the consequences of those messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead us as to your identity.
